We perform routine maintenances to our site and temporarily shut down services from time to time or for some time longer than normally expected.

Every user interested in joining or receiving service from us (tutor, volunteer, student) must follow the application procedures outline on this site regardless of position.

To be eligible for our program or a position with us, a user must meet the stated criteria and requirements listed on this website. We reserve the right to grant or denied services to anyone regardless of their circumstances.

 

If you are interested in joining our program, you must follow the stated application procedure (found on this site) to determine whether you qualify for tutoring assistance or a position with us.

Your User Content

 

Your Data (personal information or any information that can be linked back to you) shall remain your own. However, by using our website or service, you grant us an irrevocable license to collect, store, use your information solely to provide services to you. This collection, storing, and use of your data will remain effective for as long as your account is active with us, or you are a guest browsing or using the site. We will not collect, store, distribute, transmit, or publicly display your data or user content for purposes other than as stated in these terms and conditions.

What is Data?

 

Data includes all Personally Identifiable Information (PII) and other non-public information. Data include, but are not limited to, the user or student data (such as name, date of birth, address, grade level, school attending, course work) and may include metadata and user content.

Student or User De-identified Data

We may use de-identified data for product development, research, or other purposes. De-identified data includes, but is not limited to, name, I.D. number, date of birth, demographic information, and school I.D. De-identified Data will have all direct and indirect personal identifiers removed. We will not attempt to re-identify de-identified Data and will not voluntarily transfer de-identified Data to any party.

 

 

Marketing and advertising

 

We will not use your Data for advertising or marketing to you (unless you have consented to a subscription with us). We do not use your data for any other purpose other than to fulfill our business relationship with you.

 

 

Modifications and collection of data

 

At this time, we do not intend to modify the way we collect, used, and shared data. However, we reserved the right to do so if or when we decide that a modification is necessary for us to operate services. We encourage you in advance to check back periodically for any changes. If you have an active account with us and sign up for our newsletter, we will inform you of any future updates.

 

 

Data Protection

 

We respect and take our users' privacy very seriously. We use secured socket layers to encrypt confidential information and implement routine checks to ensure user data stays secure. We strive to enforce security measure that protects our users from data compromising, but nothing on the internet is risk-free. If we encounter a breach in any of our data, we will notify our users and make the appropriate adjustments to rectify the situation.

Accounts

 

You are responsible for providing truthful and accurate account information. Your management includes any updates to your account information. Your information allows us to contact you as needed to provide you with good services. You acknowledge that we are not responsible for any error or miss-delivered transaction over your failure to update your information.

 

Parents/ Students:

 

You agree always to keep your username and password safe for your usage. In no way are you authorize to share your account (referring to a parent's child's/ student account) with another person (or their child/ another student who is not the registered owner of the account) to impersonate your child to benefit from a tutoring session.

You accept that the application you filled out pertains to only services for the child you registered with us. If you have other children, you must fill out a solo application for each one. There are no exceptions to registering an account with us. Siblings may not use each other's accounts. You understand that accounts registered to their respective users are condition upon their service from us. Registered accounts help us identify user needs and assistance best and stay compliant with applicable laws. For these reasons, only registered users may have access to their accounts.

 

Please keep your child's account for your child's use only. Do not share it with any one else (registered or not). Breaching this agreement will result in your child's termination from the program; allowing anyone else to pose and use your child's account places yourself at liability risk. Terminated accounts may not qualify for re-enrollment at a later date. You are responsible for sharing this fact with your child (student).

Tutors/ Volunteers:
​
We value your time and efforts to contribute to our cause. We also understand and respect that unforeseen happens can alter plans for you at any given time. Therefore, if for any reason, you can not be available for a tutoring session you agree to do. In that case, you must follow our standard protocol to cancel it. Information on scheduling and canceling bookings, is found in our Tutor/ Volunteer handbook of regulations. 

 

You agree that you have been granted a limited license to tutor/volunteer with us. You agree to uphold the integrity and ethical values of the services to which you have consented. You may not allow anyone else to use your account. Anyone else refers to family members, friends, colleagues, and third parties not registered with us. You understand that allowing others to pose as yourself to fulfill any tutor sessions with a student you are under contract to tutor is illegal and unethical. You understand that by compromising your account in this way, you risk all legal damages associated with your account.

 

You further acknowledge that your application agreement binds you to your contract and these terms and conditions including all terms set forth in the Tutor/Volunteers Handbook of Regulations for as long as you hold a position with us.

 

As a tutor or volunteer, you have sworn to uphold the virtues of education and are considered a role model with respect and honesty to the student you are tutoring. Therefore, by allowing an unregistered/registered user to pose as yourself, you have neglected and violated your agreement with us and place yourself at liability risk. 

​

If you are sick or can not tutor the day you have a sign-up, please refer to our Tutor/ Volunteer handbook of regulations on canceling existing appointments. 

 

All Users:

 

You acknowledge that your contract only allows you to use your account. You may not allow others to access your account. We are not responsible for compromised accounts, and in doing so, you risk any damages that may occur from it. Any user that allows another user (registered or not) to use their account will be terminated immediately and not be allowed to register for service or a position with us again.

 

Impersonation is a federal offense, and we do not tolerate it.

 

Having an account with us does not guarantee an indefinite relationship with us. As a user, you understand these terms & conditions. If we believe you have breached any part of these terms, we may terminate your account with or without notice. 

 

We reserved the rights to suspend, refuse service or reinstate or suspend any accounts at any given time. 

 

In the event, your account has been deactivated, suspended, or terminated, and you feel there has been an error, you may appeal our decision by writing to us at:

Lesson Agreements

 

Tutoring Sessions

 

We make every effort to offer our best support and accessibility to all our students. 

​

You accept that all lesson hours are forward-moving. Every student is only allowed a maximum of three hours per week. Therefore, if your child cancels any bookings, they will lose the cancel hours. Lost hours will not be reimbursed.

 

Lessons are preferred to be one on one between tutors and students. However, we reserve the right to allow conference lessons from time to time when necessary to maximize support for all students. During tutoring sessions, a tutor may give a solo lesson or permit a group lesson of no more than three students altogether. Suppose you scheduled a solo lesson, and the available tutor has other students in the study sessions. In that case, you may cancel your appointment and reschedule for another day if it is on a Monday, Tuesday, or Wednesday. If you cancel your lesson on a Thursday, it may not be possible to rebook another class for the following weekdays since the weekend is approaching, and studies need to be scheduled 24 hours in advance. All hours are forward-moving, and you may lose the hour you have refused.

The Glisteners Foundation does not offer weekend tutoring currently.

 

Code of Conduct

 

Parents are responsible for reviewing these our terms and conditions with their children to help students understand our organization's policies and procedures. If you have any questions not answered in the handbook, you may contact us through Questions & Concerns.

 

By registering with us a user agrees that they will reframe from disrupting instructional time. Not disrupting includes not interrupting others during conference lessons with a tutor or engaging in inappropriate activities that may cause injury, humiliation, or damages to other users. You agree that you will not use the site or program for any other purpose other than its objective as an educational site for tutoring sessions.

Links to third-party websites

 

For educational purposes, from time to time, some of our tutors may share their screens or link lessons to other sites. This interaction allows young learners to visualize and comprehend the content at hand. Parents are responsible for informing tutors ahead of time if they do not want tutors to share this feature with their child over the whiteboard.

Hyperlinks to Third-Party Websites

 

This website may contain hyperlinks to other websites for information purposes. The Glisteners Foundation does not monitor or hold any control over other websites or the way they operate. We are not responsible for any loss or damages you may incur from using such sites, whether your reason to use them is for informational purposes or not.

Prohibited Activities

 

You agree not to use the site for any illegal, immoral or unauthorized activities. 

 

You may not use this site to threaten, harass, stalk, or defame us, our staff, agents, business partners, affiliates, sponsors, or any other users at any time. These restrictions shall extend to uploading pornographies, other explicit or indecent contents, works that may be considered copyright infringements, fake news, fighting words, images, or pieces that support or provoke racism or prejudice. You may also not create hate or inflict or entice harm to others, including but not limited to bullying and creating a hostile environment while using this website. You further agree not to upload any malicious code or program written to infest the site with spiders, bots, malware, spyware, ringworms, trojan, or any other cyber hack that may cause harm to our site or us at any time. You agree not to use our site for solicitation and marketing for your interest. 

 

All intentional misuse and attacks on The Glisteners Foundation will be subjected to criminal review and prosecute to the fullest extent allowed by law.

All intellectual property shall remain the rights of its respective owner. All images, trademarks, designs, and logos on this website may not be reproduced, distributed, advertised, use, borrowed or leased by you before receiving permission from its rightful owners. You agree to not infringe any original copyright, trademarks, database rights, moral rights, design rights, confidentiality rights, and any other rights according to applicable laws.

 

You understand that federal laws protect original work of authorship, and any infringement occurrence may be subjected to criminal review and prosecute to the fullest extent allowed by law.

You agree to indemnify, defend, and hold harmless The Glisteners Foundation, all staff, agents, directors, affiliates, business partners, sponsors, and any associates (under our services) from claims and stipulation, including legal fees, constructed by any third party as a result from your breach to these terms and conditions and violations to their terms and rights.

Disclaimer/ Waiver

 

We strive to implement appropriate security measures for our users, website, and services as much as possible. Still, you acknowledged that in this time and age, in our modern environment, cyber hackers and criminals continue to roam the digital platform and our communities for vulnerabilities of all sorts. For that reason, nothing is risk or attack-free regardless of any security standard. In no way are we responsible for any damages that may occur to you, your family members, or your property while using our site or services. Therefore, you agree that you are voluntarily using our site and services at your discretion and acknowledge all risks associated. 

 

You agree to hold The Glisteners Foundation, all its staff, agents, affiliates, business partners, sponsors, and any associates (under our services) harmless and waive all injuries that you may incur resulting from your use of the site or program. 

 

The scope of these injuries shall extend but not be limited to medical and health damages, whether mental or psychological impairments, physical incapacities, or emotional compromising/impairments. These injuries shall also include economic loss, time consumption, and all other investments that you may have a loss that is considered valuable to you. Furthermore, this includes computer malfunctioning due to spiders, bots, malware, spyware, and other types of cyber-attack your laptop or computer may acquire or encounter from using the site or program.

Business Vendors/ Sub-contractors/ Developers

Should you be hired, you agree to be bound by these terms and conditions and produce honest and ethical work. You agree that you have the qualified skills to complete the task or work we have contracted you to do. Payments will resume after all work has been satisfied, completed, and approved by the authorized departments. 

 

You further understand that our contract to you does not cover leasing or borrowing data, nor does it cover liability insurance from any third party claims to damages your work may cause to them, their rights or their properties. For example, but not limited to damages or injuries that may arise from your work onto their website/websites, from working on ours.  You understand that another company hosts our site, and therefore we may use other third-party applications. You consent not to upload any malicious software to cause damages to us, our site, or the host site or any other affiliated sites while completing any job task for us.

Suppose you breach any part of these conditions. In that case, you agree to indemnify us, our directors, agents, staff, sponsors, affiliates, and any associates (under us) from any third-party claims that have resulted from your actions.

Arbitration Agreement ( Dispute Policy )

 

We aim to provide equity and quality service for all our users and understand that not everyone may always have the same experience. If you have reasons to believe we have violated you, you agree to settle your dispute with us through arbitration; this does not include any rights you have already consented to waived under these Terms and Conditions. Under this arbitration term, you agree to waive all legal proceedings and allow us to act as a mediator by agreeing to resolve your claim through our settlement protocol. 

 

To validly initiate a claim, you must report all concerns to us as soon as you can; this means not leaving out too much time apart from the time of the incident to the time you report it. Under this arbitration agreement, you agree you will inform us when the incident happens to allow us appropriate time to investigate your claim. Please note that you are responsible for submitting all evidence associated with the situation by submitting a claim. After a thorough investigation, if we find that your claim proves to have validity, we will provide or resume with an appropriate remedy. We reserved the right to investigate and approve or dismiss all claims.

 

 

Governing Law & Jurisdiction

 

These terms and conditions and all active contracts you hold with us remain governed by the laws of the United States of America and the jurisdiction of Indianapolis, Indiana.

Duration of Terms

 

These Terms and Conditions, including Terms of Use and Privacy Policy, shall remain effective until your relationship with us terminates.
